• Third-Party Social Media Service means any services or content provided by a third party that may be displayed, included, or made available by the Service.

• You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Acknowledgment

These Terms and Conditions govern the use of our Service and form the agreement between You and Airwave Heating and Cooling LLC. They set out the rights and obligations of all users regarding the use of the Service.

HVAC Services — Scope and Limitations

Estimates and Pricing

All estimates provided by Airwave Heating and Cooling — whether by phone, email, online form, or in-person assessment — are estimates only and not binding quotes unless confirmed in writing. Final pricing may vary based on the actual condition of equipment found upon inspection, parts required, labor time, and any additional issues discovered during the course of the repair or installation.

We provide a written estimate prior to beginning any work. No work will commence without your explicit approval of the estimate. You have the right to decline service after receiving an estimate without obligation.

Diagnostic Fees

A diagnostic service fee may apply to repair calls. Where a diagnostic fee is charged, it will be applied toward the total cost of the repair if you proceed with the service. Diagnostic fees are non-refundable if you choose not to proceed with the recommended repair.

Warranties and Guarantees

Airwave Heating and Cooling warrants all labor and workmanship performed by our technicians. Parts warranties are governed by the respective manufacturer's warranty terms. Warranty coverage is void if:

• The equipment is serviced, modified, or repaired by an unauthorized third party after our service
• The equipment failure results from misuse, neglect, improper operation, or failure to perform recommended maintenance
• The equipment failure results from Acts of God, power surges, flooding, or other events outside our control

Manufacturer equipment warranties for new installations require annual professional maintenance to remain valid. We recommend scheduling annual HVAC tune-ups to maintain both system performance and warranty coverage.

Emergency Service

Emergency HVAC repair service is available 24 hours a day, 7 days a week. Emergency service calls outside regular business hours may be subject to after-hours service rates, which will be disclosed prior to dispatch.

Customer Responsibilities

To enable safe and effective HVAC service, you agree to:

• Provide safe and reasonable access to all equipment, including furnaces, air handlers, outdoor condenser units, ductwork access points, and electrical panels as needed
• Disclose any known hazards at the service location, including but not limited to asbestos, mold, gas leaks, or electrical issues
• Ensure a responsible adult (18 or older) is present at the property during all service calls
• Maintain equipment according to manufacturer recommendations between service visits

Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms and Conditions. Upon termination, your right to use the Service ceases immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Airwave Heating and Cooling LLC or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Property damage not directly caused by our technicians' negligence
• Personal injury not directly caused by our technicians' negligence
• Secondary damage resulting from HVAC equipment failure between service calls
• Data loss or business interruption

The entire liability of the Company under any provision of these Terms shall be limited to the amount actually paid by You for the specific service giving rise to the claim, or $100 USD if no payment was made.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such states, liability will be limited to the greatest extent permitted by law.

"As Is" and "As Available" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service.

The Company makes no warranty or representation that:

• The Service will meet your specific requirements or expectations
• HVAC repair will resolve all equipment issues in a single visit in every circumstance
• Equipment repaired will not require further service in the future due to age, condition, or unrelated failures
• The website will be uninterrupted, error-free, or free of viruses or other harmful components

Governing Law

The laws of the State of Illinois, United States, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in McHenry County, Illinois.

United States Legal Compliance

You represent and warrant that you are not located in a country subject to a United States government embargo, or designated as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified and interpreted to accomplish its objectives to the greatest extent possible under applicable law. The remaining provisions will continue in full force and effect.

Waiver

Failure to exercise a right or require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any later time. A waiver of any breach shall not constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice before new terms take effect.
